Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Vysiro Inc. ("Vysiro," "we," "us," or "our"), governing your access to and use of the Vysiro website at vysiro.com, including all associated services, APIs, tools, and features (collectively, the "Service").

By creating an account, accessing the Service, or using any part of the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to that organization.

2. Description of Service

Vysiro is a domain trust infrastructure platform that provides the following services:

• Domain Security Scanning: Comprehensive analysis of DNS, email authentication (DMARC, SPF, DKIM), SSL/TLS certificates, DNSSEC, and related infrastructure configurations.
• TrustScore: A composite security score ranging from 0 to 1000, calculated across 29 security categories, reflecting the overall trust posture of a domain.
• AI-Powered Analysis: Automated threat assessment, risk evaluation, and remediation guidance powered by AI agents.
• DNS Fix Guidance: Provider-specific instructions and, where available, automated DNS record modifications through connected provider APIs.
• API Access: Programmatic access to scanning, scoring, and reporting capabilities through our REST API and MCP (Model Context Protocol) server.
• Compliance Reporting: Assessment of domain infrastructure against security frameworks including SOC 2, PCI DSS, NIS2, CISA, NIST, and GDPR.
• Monitoring and Alerts: Ongoing surveillance of domain configuration changes with notification capabilities.

The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

3. Account Registration and Security

Certain features of the Service require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials, including passwords and API keys.
• Immediately notify us at Support@vysiro.com of any unauthorized use of your account or any other security breach.
• Accept responsibility for all activities that occur under your account.

API keys issued to your account are prefixed with vysiro_sk_ and are hashed using SHA-256 before storage. You are solely responsible for safeguarding your API keys and must not share them publicly or embed them in client-side code.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are in violation of these Terms.

4. Subscription Plans and Billing

Vysiro offers the following subscription tiers:

Billing. All paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. Annual plans receive a 20% discount compared to monthly billing. All prices are in United States Dollars (USD) and are exclusive of applicable taxes unless stated otherwise.

Guided Fix Charges. On paid plans, each verified DNS fix applied through Push Fix incurs an additional charge of $5 per fix. Fixes are user-initiated: you will be notified and must confirm before any guided fix is applied and billed.

Renewals. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your dashboard settings.

Refunds. Subscription fees are non-refundable except where required by applicable law. If you cancel a subscription, you will retain access to paid features until the end of your current billing period.

Price Changes.We reserve the right to change pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

5. Free Tier Terms

The Free tier provides limited access to the Service at no cost, subject to the following conditions:

• You may monitor up to 1 domain.
• AI chat interactions are limited to 25 per month.
• Push Fix allowance is 0 (not available on the Free tier).
• API access is rate-limited and subject to usage quotas.
• Compliance reporting is not available; access to benchmark data and PDF reports requires a paid plan.

We reserve the right to modify, limit, or discontinue the Free tier at any time. Free tier accounts that remain inactive for more than 12 consecutive months may be subject to deletion after prior notice.

6. API Usage and Rate Limits

Access to the Vysiro API is governed by the following terms:

• Authentication: All API requests to authenticated endpoints must include a valid API key. Unauthenticated public endpoints (such as the public score endpoint) are subject to stricter rate limits.
• Rate Limits: API usage is subject to rate limits that vary by subscription tier. Exceeding rate limits will result in temporary throttling (HTTP 429 responses). Persistent or deliberate abuse of rate limits may result in account suspension.
• Quotas: Each subscription tier includes a monthly API quota. Usage beyond the allocated quota may result in degraded service until the next billing cycle or may require an upgrade to a higher tier.
• MCP Server: The Vysiro MCP server endpoint is provided for integration with AI agents and development tools. MCP usage is counted toward your API quota.
• Acceptable Use: You may not use the API to build a competing service, scrape data in bulk for redistribution, or circumvent subscription tier restrictions.

We reserve the right to modify rate limits and quotas at any time. Changes to rate limits for paid tiers will be communicated with at least 14 days' notice.

7. DNS Fix Guidance Disclaimer

Vysiro provides DNS fix guidance, including provider-specific instructions, zone file recommendations, and, where DNS provider APIs are connected (such as Cloudflare), automated DNS record modifications. You acknowledge and agree that:

• Guidance Only: DNS fix recommendations are provided as guidance. You are solely responsible for reviewing, validating, and approving any changes to your DNS records, whether applied manually or through connected provider APIs.
• User Responsibility:You are solely responsible for any DNS changes made to your domains, including changes initiated through Vysiro's automated fix capabilities. You should verify that all changes are correct and appropriate for your environment before applying them.
• No Guarantee: Vysiro does not guarantee that applying recommended fixes will resolve all security issues, prevent service disruptions, or achieve a specific TrustScore.
• Provider Access: When you connect a DNS provider account (e.g., Cloudflare) to Vysiro, you grant Vysiro permission to read and modify DNS records on your behalf. OAuth tokens are encrypted using AES-256-GCM and stored securely. You may revoke provider access at any time through your dashboard settings.

Vysiro shall not be liable for any downtime, email delivery failures, security incidents, or other damages resulting from DNS changes made through the Service, whether automated or manual.

8. Intellectual Property

Our Property. The Service, including but not limited to the TrustScore algorithm, scanning engines, AI analysis models, compliance frameworks, user interface, documentation, logos, and all related intellectual property, are owned by Vysiro Inc. and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

Your Data. You retain all ownership rights to the domains, configurations, and data you submit to the Service. By using the Service, you grant Vysiro a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.

Feedback. If you provide feedback, suggestions, or ideas about the Service, you grant Vysiro an unrestricted, irrevocable, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.

9. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy. We use Firebase Authentication for identity management and Firestore for data storage, with tenant isolation to ensure your data remains segregated and secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VYSIRO INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VYSIRO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VYSIRO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Prohibited Uses

You agree not to use the Service to:

• Scan or assess domains that you do not own or do not have explicit authorization to test.
• Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service, including the TrustScore calculation methodology.
• Use the Service to build a competing product or service, or systematically scrape, harvest, or redistribute scan results or TrustScore data.
• Transmit any viruses, malware, or other harmful code through the Service.
• Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Service.
• Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
• Misrepresent your identity, impersonate another person, or falsely claim affiliation with any organization.
• Share, resell, or sublicense your account or API keys to third parties without prior written consent from Vysiro (except as permitted by your MSP Partner plan terms).

Violation of these prohibited uses may result in immediate suspension or termination of your account, at our sole discretion, without refund.

12. Termination

By You. You may terminate your account at any time by cancelling your subscription through the dashboard and deleting your account. Upon cancellation, your access to paid features will continue until the end of the current billing period.

By Vysiro. We may suspend or terminate your account and access to the Service at any time, with or without cause, including but not limited to: (a) violation of these Terms; (b) non-payment of fees; (c) suspected fraudulent, abusive, or illegal activity; or (d) extended inactivity.

Effect of Termination. Upon termination, your right to use the Service will immediately cease. We may, at our discretion, delete your account data, scan history, and associated records. We will make reasonable efforts to provide you with an opportunity to export your data before deletion, except in cases of termination for cause.

Sections of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property, Limitation of Liability, and Governing Law) will survive any termination of these Terms.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you by email (sent to the address associated with your account) or by displaying a prominent notice within the Service at least 30 days before the changes take effect.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration to be conducted in Cheyenne, Wyoming.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
